The use of our website is generally possible without providing personal data. This privacy policy provides users with information about the nature, scope and purpose of the collection and use of their data by the responsible provider.

The legal framework for data protection is provided by the German Federal Data Protection Act (BDSG) and the German Telemedia Act (TMG).

 

Collection of general information

With each access to this offer, information is automatically collected by us or the web space provider. This information, also referred to as server log files, is of a general nature and does not allow any conclusions to be drawn about your person.

Among other things, the following data is collected: Name of the website, file, date, amount of data, web browser and web browser version, operating system, the domain name of your Internet provider, the so-called referrer URL (the page from which you accessed our offer) and the IP address.

Without this data, it would not be technically possible to deliver and display the contents of the website. In this respect, the collection of the data is mandatory. In addition, we use the anonymous information for statistical purposes. They help us to optimize the offer and the technology. We also reserve the right to subsequently check the log files if we suspect illegal use of our offer.

 

Handling personal data

Definition: Personal data is any information that uniquely identifies a person. It is therefore data that can be traced back to a person.

This personal data includes the first name and surname, telephone number and e-mail address. 

This data is only collected, used and, if necessary, passed on by the provider if this is expressly permitted by law or if the user consents to the collection, processing, use and passing on of the data.

Disclosure to third parties

We do not sell or rent personal information to marketers or to third parties not affiliated with us. In particular, we share your personal data with the following trusted third parties:

a. To service providers of Crowd-Architects GmbH. We share data with service providers who assist us in providing the Services. Service providers help us in particular with the following: payment processing (i.e. banks, credit bureaus, payment service providers), website hosting, data analytics, information technology and related infrastructure, email delivery and auditing,

b. To Third Parties. We disclose information to third parties in the event of a reorganization, merger, sale, joint venture, assignment, transfer or disposition, in whole or in part, of our business, assets or stock (including in connection with bankruptcy or similar proceedings); and

c. Security, Lawful Purposes and Law Enforcement. We will use and disclose information as we deem necessary (i) under applicable law or regulation with respect to the method of payment, (ii) to enforce our Terms, (iii) to protect our or your rights and property or the rights and property of our affiliates or others and for privacy or security purposes, and (iv) to comply with orders of courts, law enforcement agencies, regulators and other agencies and governmental authorities.

 

Contact form

If you send us inquiries via the contact form, the information you provide in the inquiry form, including the contact data you enter there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. The contact form transmits the contact request, as well as the contact address for the purpose of answering by e-mail or telephone. For the use of our contact form, the express consent for the transmission of the information provided there is required. 

The request is usually stored for 6 months after receipt in order to be able to refer to it for follow-up questions. Longer storage takes place if this is required or permitted for legal reasons.

The storage can be objected at any time.

 

Newsletter dispatch

If you would like to receive the newsletter offered on the website with regular information about our offers and products, we require your e-mail address as mandatory information. Additional data is provided in order to be able to address you personally in the newsletter and/or to identify you if you wish to exercise your rights as a data subject.
We use the so-called double opt-in procedure for sending the newsletter. This means that we will only send you our newsletter by e-mail if you have expressly confirmed that you consent to the sending of newsletters. In the first step, you will receive an e-mail with a link that you can use to confirm that you, as the owner of the corresponding e-mail address, want to receive newsletters in the future. With the confirmation, you give us your consent pursuant to Art. 6 para. 1 lit. a DSGVO that we may use your personal data for the purpose of the desired newsletter dispatch.

When registering for the newsletter, we store, in addition to the e-mail address required for sending, the IP address through which you registered for the newsletter, as well as the date and time of registration and confirmation, in order to be able to track possible misuse at a later date.
You can unsubscribe from the newsletter at any time via the link included in each newsletter or by sending an e-mail to the responsible person named above. After unsubscribing, your e-mail address will be deleted immediately from our newsletter distribution list, unless you have expressly consented to the continued use of the data collected or the continued processing is otherwise permitted by law.

Our email newsletters are sent via the technical service provider HubSpot Ireland Limited, Ground Floor, Two Dockland Central, Guild St, North Dock, Dublin, D01 R8H7 Dublin ("HubSpot"), to whom we pass on the data you provided when registering for the newsletter. This transfer takes place in accordance with Art. 6 (1) lit. f DSGVO and serves our legitimate interest in using an effective advertising, secure and user-friendly newsletter system. The data you enter for the purpose of receiving the newsletter (e.g. email address) is stored on HubSpot's servers in Germany.

HubSpot uses this information to send and statistically evaluate the newsletters on our behalf. For the evaluation, the sent emails contain so-called web beacons or tracking pixels, which are single-pixel image files that are stored on our website. This makes it possible to determine whether a newsletter message has been opened and which links, if any, have been clicked on. With the help of so-called conversion tracking, it can also be analyzed whether a predefined action (e.g. purchase of a product on our website) has taken place after clicking on the link in the newsletter. In addition, technical information is collected (e.g. time of retrieval, IP address, browser type and operating system). The data is collected exclusively pseudonymously and is not linked to your other personal data, a direct personal reference is excluded. This data is used exclusively for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

If you wish to object to data analysis for statistical evaluation purposes, you must unsubscribe from the newsletter.

We have concluded an order processing agreement with HubSpot, in which we oblige HubSpot to protect our customers' data and not to pass it on to third parties.

If applicable, data will be transferred to the USA to HubSpot Inc. HubSpot is certified for the US-European data protection agreement "Privacy Shield", which ensures compliance with the level of data protection applicable in the EU. Integration of third-party services and content

Our website uses Squarespace Metrics, a web analytics service provided by Squarespace, Inc, 225 Varick Street, New York, NY 10014, USA ("Squarespace"). Squarespace Analytics uses cookies. The data generated by cookies about the use of our website is transmitted to a Squarespace server in the USA and stored there. Use HubSpot

We use HubSpot on our website for marketing activities. HubSpot is a US-based software company with a branch office HubSpot Ireland Limited at 2nd Floor 30 North Wall Quay, Dublin 1, Ireland ("HubSpot"). We use this integrated software solution for our own marketing, lead generation and customer service purposes. This includes, but is not limited to, email marketing which governs the sending of newsletters as well as automated mailings, social media publishing and reporting, contact management such as user segmentation and CRM, landing pages and contact forms. HubSpot uses cookies, which are small text files that are stored locally in the cache of your web browser on your terminal device and enable an analysis of your use of the website by us. HubSpot analyzes the information collected (e.g. IP address, geographical location, type of browser, duration of visit and pages viewed) on our behalf so that we can generate reports about the visit and the pages visited. Use of YouTube components with extended data protection mode

On our website we use components (videos) of the company YouTube, LLC 901 Cherry Ave, 94066 San Bruno, CA, USA, a company of Google Inc, Amphitheatre Parkway, Mountain View, CA 94043, USA.

Here we use the option provided by YouTube " - extended data protection mode - ". When you call up a page that has an embedded video, a connection is established to the YouTube servers and the content is displayed on the website by informing your browser. d. Privacy policy for Google Analytics IP anonymization

We use the function "Activation of IP anonymization" on this website. However, this means that your IP address is shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. Use of Google Adwords conversion tracking 

We use the online advertising program "Google AdWords" and, as part of Google AdWords, conversion tracking. Google Conversion Tracking is an analysis service provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"). When you click on an ad placed by Google, a cookie for conversion tracking is stored on your computer. These cookies lose their validity after 30 days, do not contain any personal data and are therefore not used for personal identification.
If you visit certain web pages on our website and the cookie has not yet expired, Google and we can recognize that you have clicked on the ad and have been redirected to this page. Each Google AdWords customer receives a different cookie. Thus, there is no way that cookies can be tracked across AdWords customers' websites.
The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. This tells customers the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

Use of Facebook Remarketing

The Provider uses the "Custom Audiences" remarketing function of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") on the Website. By means of this function, the provider can target visitors to the website with advertising by displaying personalized, interest-related Facebook ads for visitors to the website when they visit the Facebook social network. To perform the function, the Remarketing Tag of Facebook is implemented on the website of the Provider.

Via this tag, a direct connection to the Facebook servers is established when visiting the website. This transmits to the Facebook server which of our web pages you have visited. Facebook assigns this information to your personal Facebook user account. Use LinkedIn

The so-called Insight Tag of the social network LinkedIn is used on our pages. This is offered by LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA ("LinkedIn"). The LinkedIn Insight Tag is a small JavaScript code snippet that we have added to our website.

The LinkedIn Insight tag enables the collection of data about visits to our website, including URL, referrer URL, IP address, device and browser characteristics, timestamps, and page views. This data is encrypted, anonymized within seven days, and the anonymized data is deleted within 90 days. LinkedIn does not share any personally identifiable information with us, but only provides aggregate reports on website audience and ad performance. LinkedIn also provides retargeting for website visitors, so we can use this data to display targeted ads outside of our website without identifying the member. LinkedIn members can control the use of their personal data for advertising purposes in their account settings.

a) Purpose of the data processing

The LinkedIn Insight tag is used for the purpose of providing detailed campaign reporting and information about our website visitors to serve our advertising and marketing interests. As a customer of LinkedIn Marketing Solutions, we use the LinkedIn Insight tag to track conversions, retarget our website visitors, and gain additional information about the LinkedIn members who view our ads.

b) Legal basis of the data processing

The legal basis for the processing of personal data is Art. 6 (1) (f) DSGVO, i.e. a legitimate interest on our part. Our legitimate interest here lies in the above-mentioned purposes.

c) Duration of storage

The data is encrypted, anonymized within seven days, and the anonymized data is deleted within 90 days.

However, as a user you can also decide yourself at any time about the execution of the Java Script code required for the tool via your browser settings. By changing the settings in your Internet browser, you can disable or restrict the execution of Java Script and thus also prevent its storage. Note: If the execution of Java-Script is deactivated, it may no longer be possible to use all the functions of the website in full.

d) Possibility of objection and removal / Opt-Out

If you are a LinkedIn member and do not want LinkedIn to collect data about you via our website and link it to your membership data stored on LinkedIn, you must log out of LinkedIn before visiting our website.

You can prevent the execution of the Java Script code required for the tool by setting your browser software accordingly.

Registration for our webinars

In order to be able to conduct webinars via the Internet, we use the GoToWebinar software solution from LogMeIn Ireland Limited, Bloodstone Building Block C, 70 Sir John Rogerson's Quay, Dublin 2, Ireland ("GoToWebinar"). For the provision of this service and the related data processing, LogMeIn, Inc. is the data controller. LogMeIn's privacy policy can be found at https://www.logmeininc.com/de/legal/privacy. For the implementation of the webinar, we transmit your registration or customer data to LogMeIn, Inc. The processing of your data is based on your consentist in accordance with Art. 6(1)(a) DSGVO. For the execution of the webinar, an encrypted connection is established between you and the organizer of the webinar. The webinars are regularly recorded in order to make them available on our websites for later retrieval. Questions asked by participants during the seminar and associated answers are also recorded and played back when the webinar is later retrieved. Statistical data is collected during and after the webinar. If you participate in a webinar, in addition to your registration data, we receive information about the duration of participation, interest in the webinar, questions asked or answers given for the purpose of further customer support or to enhance the user experience.

Publication of job advertisements / online job applications

Your application data will be collected and processed electronically by us for the purpose of handling the application process. If your application is followed by the conclusion of an employment contract, your transmitted data may be stored by us in your personnel file for the purpose of the usual organizational and administrative process in compliance with the relevant legal provisions.
If your job application is rejected, the data transmitted by you will be deleted automatically two months after notification of the rejection. This does not apply if longer storage is necessary due to legal requirements (for example, the duty of proof under the General Equal Treatment Act) or if you have expressly consented to longer storage in our database of interested parties.

 

Security

We implement appropriate organizational, technical and administrative measures within our company to protect personal data. Unfortunately, the security of any data transmission or data storage system can never be fully guaranteed. If you have reason to believe that your use of our services is no longer secure (for example, if you feel that your account has been accessed without authorization), please contact us immediately.

 

Data economy

In accordance with the principles of data avoidance and data economy, we store personal data only for as long as is necessary or required by law (statutory storage period). If the purpose of the information collected no longer applies or the storage period ends, we block or delete the data.

 

Your rights to information, correction, blocking, deletion and objection

You have the right to request information, free of charge, about the personal data stored by us and/or to request correction, blocking or deletion. Exceptions: It is the prescribed data storage for business processing or the data are subject to the statutory storage obligation.
